DUI information.

It is important to understand that if someone has been arrested for a DUI in California there are two separate and parallel proceeding that take place. One proceeding is through the Court system and the second proceeding is through the Department of Motor Vehicles. The court proceeding is considered a criminal matter. The DMV proceeding is an administrative hearing. Generally it is the DMV that suspends your driving privileges and not the court.
You have only ten days after receiving a 23152(b) to contact DMV and request a hearing. If you do not contact DMV your license will suspended for 4 months with a first DUI offense.
